Canada has not been a passive observer in Omar’s ordeal. When Omar was being ill-treated and abused, when he was being denied basic legal rights that Canadians regard as fundamental, when Omar needed Canada the most, Canada failed to come to Omar’s aid. Not only this, Canada actively participated by sending CSIS agents to interrogate Omar after he had been “softened up” through ill-treatment. Canada then shared the contents of the CSIS interviews with US authorities.
This summer, in a unanimous decision, the Supreme Court of Canada found that the conditions under which Omar was being detained “constituted a clear violation of fundamental human rights protected by international law.” The Supreme Court held that Canada knew about Omar's mistreatment, and was complicit in violating Omar’s rights under the Canadian Charter of Rights and Freedoms and the Geneva Conventions.
