This will be the second time that Omar Khadr's case has gone to the Supreme Court. The first time, the Supreme Court only considered whether Canada could be forced to release documents to Omar Khadr. They found that Khadr's Charter rights had been violated by Canada's participation in the Guantanamo regime in violation of international law, and ordered disclosure of the documents. This time, based once again on Canada's participation in human rights violations against Omar Khadr, the Supreme Court is being asked to order Canada to seek Khadr's repatriation.
